It's easier to charge with a larger penalty and go downward rather than the reverse.

I thought Scott Brookes had a pretty good statement regarding fan behaviour:

Cole Buckley, the 21 year old fan from Braintree who threw the water bottle at Currie, could face up to 10 years in prison for “assault and battery with a dangerous weapon”.

10 years is a bit excessive  :angel: maybe a couple months will be punitive enough to act as a deterrent to others? I’m not sure how these sentencing things work.

They also stated "dangerous weapon"

Which is over the top imo

Would be surprised if gets jail time.

I think it's good to overcharge this kid. It shows that Boston is serious and these fans are getting a little too comfortable. I know it's only popcorn and a water bottle, but I would be very upset if somebody spit or did any of that on me. Then you have the guy that got tackled last night. High charges will at least, hopefully, make fans think twice before acting like idiots.

I think it's good to overcharge this kid. It shows that Boston is serious and these fans are getting a little too comfortable. I know it's only popcorn and a water bottle, but I would be very upset if somebody spit or did any of that on me. Then you have the guy that got tackled last night. High charges will at least, hopefully, make fans think twice before acting like idiots.

It's the defense attorney in me, but in my mind it's never okay to overcharge.  The justice system shouldn't be about setting somebody up as an example.

Treat everybody with consistency and fairness.  If actions don't warrant prosecution for A&B with a deadly weapon, then don't charge it.  Otherwise, it's just a prosecutor manipulating the system to screw certain parties.  That happens way too much in our system, and I don't want to see more of it.

In some ways, I agree with you but isn't that part of the goal of the justice system? To set examples to prevent others from doing it? Although I can see how that by itself can be corrupted so I see your point. I guess I am okay in some high profile and especially minor cases if it deters others but I do see your point.

Anyone that thinks some guy should go to jail for tossing a half empty plastic water towards someone is a lunatic.  Kicked out of arena - fair,  but incarceration????

Deterring future behavior is part of the role of the justice system, but I'm not sure that isolated public examples serve that goal.  If you treat everybody with some level of consistency, it both creates more faith in the system and allows people to have reasonable expectations about what their punishment may look like.  If we give 10 people a year in jail and 90 people are sentenced to community service, what message does it send, other than that justice is arbitrary and that 10% of people are getting screwed?

Because we as fans hate other players, we want our players to hate those players too, to validate our own hate. Unfortunately it doesn't really work that way. They're all ultimately part of the same brotherhood that we will never be part of, that of an NBA player. These guys do public events, charities, media appearances together. They may share the same agent. And even more so these days that everyone has cellphones and social media they're connected in ways that previous players never were.

But that's ok. I personally don't need them to hate the opposition, I just need them to beat the opposition. I'll do the hating from the safety of my couch :angel:

NBA players used to hate other NBA players and were not afraid to say so.

Also, back in the 60's, 70's, 80's NBA players may not have hated an opponent, but they didn't choose them as their hug buddy either. Paul Silas talked about never helping an opponent up off the floor because he viewed them as the enemy.. Remember Larry Bird when he and Magic made their famous Converse commercial in French Lick and Johnson assumed they would be a little friendlier the next season. No, said Larry. He just couldn't compete with a mindset like that.

Garnett had a say in Kyrie stomping the logo, and quite frankly, he's right. Nobody did a thing to stop/retaliate/responded to him-- not cool.

This team is soft starting with the coach down to the last/15th player on the team.  ::)

I'm guessing they're focused on how to stop the entire Nets team tonight to avoid the end of the season. The last thing they want to get involved with is a tit-for-tat that's not really basketball related. They have many, many more things to worry about. Let's have a response on the basketball court. That's why we have alumni like KG to defend us, they're no longer playing.

Focusing on their strategy to win game 5 and knocking Kyrie on his ass are not mutually exclusive.
In fact, I would say they are perfectly compatible.

It's not the 60's, 70's and 80's anymore and the game will never return to what it was. It's 2021. You just have to learn to accept that.
