Rotoworld has learned that Antoine Walker was arrested Wednesday night at Harrah's Casino in South Lake Tahoe, Nevada.
The charges stemmed from over $800,000 in gambling debts. He was led out of the high stakes area in handcuffs by Douglas County police in front of a celebrity-heavy crowd. Walker was in Tahoe to play in the American Century Classic, a celebrity golf tournament. Walker is currently in a Douglas County jail. Bail has been set at $87,000.
Thats kind of BS if they led him out in cuffs. They easily could have just led him out without the cuffs, I dont think he was a threat to start fighting the cops or fleeing
There was a warrant out for him, he was being arrested for 3 felonies, nonviolent ones but still felonies. Why should he not have been handcuffed if he was under arrest?
The police do not need to handcuff everyone who has an arrest warrant. the handcuffs are used for the officers safety or to prevent a person from hurting themselves or others. If there was no indication that Antoine was going to put up a fight, then there is no need. If he would have gone with them willingly (and I am assuming he would have), there would have been no reason to handcuff him and walk him out.
EDIT:
It must be recognized that courts have consistently held that handcuffing is a use of force and as such must meet the reasonableness requirements of Graham v. Connor. The three-part test looks at (1) the severity of the offense suspect; (2) whether the suspect posed an immediate threat to the officer or others; and (3) whether the suspect was actively resisting or attempting to evade arrest by flight.
Since I am assuming 2 and 3 arent an issue, the only other thing is the severity. not paying back a marker of that size is serious, but it is likely not the kind of serious that would necessitate cuffs.
(I didnt check the status of this case, just found it in a 2 second google search. IF someone knows it is incorrect - Roy - feel free to correct me)
