While there's a way around it regardless I do wonder if it's technically legal for the Cavs to discuss Kyrie deals with other teams right now. The deal hasn't been finalized but it has been announced, paperwork filed with the league, etc. Seems like a limbo area where the trade formally exists despite not being fully completed.
This is neither a limbo, nor unprecedented. Deals have fallen through due to failed physicals in the past. This is rare enough though so that teams typically feel comfortable announcing early.
I don't think fairweather was saying the situation is unprecedented, I think he was remarking on whether or not the Cavs are allowed to talk to other teams during this stretch where the trade has been agreed on but not finalized.
