Would it be possible to resign pierce if he gets traded to another team which then waives him / buys him out? (not considering cap space)
Also, do we have the full mle this year? I think we only have the taxpayer mle which is only 3kk$ / year instead of 5kk$?

No.  We wouldn't be able to re-sign him until next year.

So if we cut Pierce can we resign him using the MLE at 5M/yr with player options on both years and a no trade clause?

I know there is a legitimate question as to why PP would do this but maybe controlling his own destiny and giving the C's a little more room to wiggle. Ex. Pierce takes the contract restructure and we move Bass and Lee + #16 for a sign and trade of Millsap @ $10M for X years. That makes us a stronger team and gives the Jazz some assets for a guy they might let walk.

I can see Pierce doing something like that to contend on his team.

Thanks for your answer Roy. Are you sure about the MLE? I read that it comes down to whether or not a team paid the tax in the previous season?  ???

It goes by the present year.  So long as using the MLE doesn't put a team above the "luxury tax line + $4 million" hard cap (i.e., "the apron"), they're allowed to use it.

1) It seems that it lies within the loopholes of the CBA that we could buyout Pierce' 2014 contract for 5M and cut him by June 30 and then resign him for the full MLE (5.1M), thus reducing his cost next year to 10.1M.  If they signed him for two year's guaranteed, he'd still get his full money and the C's would get 5M of budget relief this coming year (while taking on the hit the following year).     However, that would run the risk of being seen by the league as an attempt to circumvent the non-renegotiable status of Pierce' contract.   The league reserves the right to overrule any attempt to circumvent the spirit of the CBA.   The penalties can be harsh if they think a team and player collude to circumvent the rules.

2) The latter trade works if we are enough under the apron such that after sending out the three roster slots (Bass, Lee & #16 --- about 14M, I think?) we have enough space for both Millsap's salary AND the cap holds for the 2 empty slots created.  So long as Millsap signed for less than 12M, I think that trade would work even without first doing anything with Pierce.

That said, I'm not sure I want to give up THAT much for Millsap.   He doesn't put us over the edge in a 'run it back' scenario and he's not a great piece for rebuilding with in a 'tear it down' scenario.

In all of the capology stuff I've read I've never come across this. This is good info but man do I dislike subjective rules like that. Penalizing a team for working within the constraints of the new CBA would just really rub me the wrong way. Even if they reserve the right, it would be like Walmart offering an unlimited plan but then when I use over 2GB of data they terminate my contract.

I don't really understand this at all. What would the cap holds be on the outgoing contracts? Previous year's salary? That seems excessive. I will research but I'm still a little fuzzy on this.

I actually think Millsap and a couple of well targeted vet mins put us in the top 3 conversation. I don't think it's reasonable to be the favorites in our conference for the next year or two but top 3 in the East puts us in contention at least this coming year. Throw in Nazr Mohammed or Sam Dalembert and probably a Pietrus type player...I'd be very happy to head into the season with that group.
