Can teams use their MLE to make a waiver bid? Or does it have to be actual cap space?

Philadelphia can't exercise the amnesty clause to clear Brand off the cap until July 11
There will be significant interest with NBA teams to claim Brand off the amnesty wire.
So...do we have cap space? I feel like I should know this, but i honetly have no idea.
Are there limitations on subsequently trading the player? Could Dallas make a claim, for example, and turn around and trade Brand to Miami (for expiring contracts and a draft pick, for example)?
