An alternative Posey idea

if we are to lose Posey, is it possible to sign and trade him so we don't end up emptyhanded AND retain our MLE?  Not sure if this can be done  under cap rules (anyone? Roy? Bueller?) - but say the hornets want him, could we send him off and take back a Julian Wright and Rasual Butler (about even salaries) and then go out and sign Maggette too? just an idea

I think the only way we could sign-and-trade Posey, while still keeping our MLE, is to sign him to a non-Bird contract. 

Incidentally, players can't be signed using the MLE and then traded.

And even if they could, why would he want to do a sign and trade with us for the MLE when he could go to another team for the same money?  All that would do would weaken the team he was going to. 

Sign and trades are usually done when a team has Bird rights to a player.

It wouldn't apply in this case, but some teams don't have access to the MLE due to being under the cap.  Doing a MLE sign-and-trade would allow Posey to go to one of those teams, if such were permitted, while still allowing that team to maintain its cap space.
